Selon Schiller, jouer, c’est agir en étant dégagé de toute contrainte et de toute obligation, et donc tirer grand plaisir de sa liberté par rapport aux nécessités. C’est ce sentiment de liberté rattachant le jeu au phénomčne esthétique de beauté qui fait sa grande valeur éducationnelle. La qualité que nous appelons beauté procure le męme plaisir que le jeu. Dans une belle śuvre d’art, la matičre n’est pas dominée par la forme ou vice-versa. Une śuvre d’art est un jeu libre (...) entre forme et substance, entre beauté et contrainte, et représente de ce fait le summum de l’activité ludique. Les jeux sont des pas sur la voie de la beauté, car ils éduquent ceux qui jouent au plaisir de la liberté de création. Contrairement ŕ la position de Schiller, Maria Montessori rejette le jeu comme moyen d’éducation. Elle pense que les enfants doivent travailler pour trouver leur voie ŕ travers les difficultés de la réalité. Or, l’analyse de ses méthodes révčle la présence de nombreux éléments de la liberté que Schiller attribue au jeu. Les enfants peuvent choisir les choses avec lesquelles ils « travaillent ». Ils ne sont pas obligés de les utiliser exactement de la maničre que l’éducateur leur montre. Et, ce qui est le plus important, les enfants prennent un grand plaisir ŕ exécuter leur « travail ». Dans cet article, l’auteur interprčte d’abord les réflexions de Schiller sur l’éducation ŕ travers le jeu, oů l’accent est mis sur l’imagination. Dans la seconde partie, l’auteur discute la question de savoir s’il est justifié de prétendre que Maria Montessori rejette l’imagination comme moyen d’éducation. (shrink)

Dans un nombre croissant de domaines scientifiques - sciences de la nature, sciences humaines aussi bien que sciences des artefacts -, la simulation ne joue plus le rôle de succédané temporaire d'une théorie encore en gésine parce que non encore élaborée ; c'est-à-dire qu'elle ne joue plus systématiquement le rôle d'un modèle provisoire ou d'un schéma servant à condenser les mesures. C'est qu'elle n'a pas la nature d'un signe graphique, linguistique ou mathématique. Elle joue au contraire de plus en (...) plus le rôle d'une réplication détaillée du réel : elle est une intuition reconstruite avec justesse mais sans abstraction rationnelle et généralisante, donc sans transfiguration iconique. Une des limites de l'épistémologie dialectique de Bachelard tient à ce qu'elle ne donne pas les concepts pour penser assez distinctement ces pratiques contemporaines de simulation. C'est pourquoi l'A. propose de concevoir l'idée que la science contemporaine se développe non plus selon la seule dialectique matérialisme / rationalisme, mais selon la triade rationalisme/computationalisme/matérialisme. C'est ainsi qu'Il avait appris que, même en sa toute-puissance, Il ne disposerait que de deux modèles fondamentaux pour créer son univers. Alors Il se dit : "Je pourrais me laisser guider par la pure rationalité de Parménide, toute de clarté et de rigueur. C'est un système remarquablement simple. Une fois que j'aurais allumé la mèche du big-bang, je n'aurais plus à m'occuper de (...) rien. Qu'est-ce qui pourrait changer dans les lois que j'aurais établies? Et comment les entités que j'aurais créées pourraient-elles ne pas leur obéir? Je n'aurais plus qu'à assister au merveilleux spectacle dont j'aurais été le créateur et le régisseur. Oui, mais voilà, je connaîtrais d'avance et jusque dans ses moindres détails le spectacle qui se déroulerait ainsi devant mes yeux. Que vaut un spectacle dont la mise en scène, chaque tableau, chaque épisode sont connus du spectateur, pour finalement se confondre en l'instantanéité d'un moment? Quelle triste perspective d'un éternel ennui! Et dans ce monde parfaitement déterminé, même le serpent le plus malin ne saurait exercer son pouvoir tentateur sur ce premier couple, qui jamais ne connaîtrait la liberté de pécher. A democratic society does not embody a permanent and internally consistent set of values but attempts to accommodate disagreement between incommensurable values. One of the purposes of the law is to manage such disagreement by ensuring that disputes are settled in a way that advances the interests of stability without foreclosing options. In this respect the function of the formal dissenting judgment has been neglected in the English literature. By contrast there is a rich US literature which reveals an ambivalent (...) attitude to the practice of dissent. The article discusses the nature of the disagreements that are predominant in dissenting judgments. It claims that the practise of dissent follows the development of democracy and that the majority of dissents in courts of last resort raise legitimate disagreement about fundamental incommensurable values. These concern disagreements between deontological and consequentialist values, between different conceptions of the legislative powers of the judiciary and between principle and pragmatism. Because the outcome of an appeal is contingent, the dissent may be as important as the majority in identifying the choices to be made and signalling the principles that are immanent in the law. The legal and political basis of the right to publish a dissent is discussed and arguments for and against the publication of dissents considered with the conclusion that constraints on the right to dissent would be self-defeating. Metodologicamente, constitui-se em uma pesquisa bibliográfica, a partir da qual realiza uma incursão crítico-analítica sobre alguns momentos da história da EJA para em seguida apontar algumas lições aprendidas. Conclui afirmando que a Ética da Libertação pode constituir-se em subsídio para a elaboração de novos horizontes de práxis de libertação no âmbito da educação brasileira e instiga à realização de pesquisas sobre a educação e suas relações com a Ética (...) da Libertação como meio de pensar em novos horizontes teórico-práticos para a EJA. Through advances in production and treatment technologies, transparent glass has become an increasingly versatile material and a global hallmark of modern architecture. In the shape of invisible barriers, it defines spaces while simultaneously shaping their lighting, noise, and climate conditions. Despite these unique architectural qualities, little is known regarding the human experience with glass barriers. Is a material that has been described as being simultaneously there and not there from an architectural perspective, actually there and/or not there from perceptual, behavioral, (...) and social points of view? In this article, we review systematic observations and experimental studies that explore the impact of transparent barriers on human cognition and action. In doing so, the importance of empirical and multidisciplinary approaches to inform the use of glass in contemporary architecture is highlighted and key questions for future inquiry are identified. In European philosophies of history, the linear paradigm that has prevailed for centuries as a derivative of Christian salvation history (Heilsgeschichte), ultimately lost its monopoly with the arrival of the “post-age.” The result of this has been that ideas that have survived on the margins, even the cyclical interpretation of time attached to religious traditions, now seem capable of outliving the short-lived belief in continuous progress. According to the cyclical view of history, those who came last will leave first, with (...) those who came first leaving as the last adherents of the driving force of Western rationalization. Thus, within a century, beginning with World War 2, a major turning point has been crossed: Socialism was the first to disappear, and it looks like Secular Liberalism will be the next; then Protestantism, followed by Islam, and so forth. As seductive as these images may appear, they only mirror an auto-destructive thread at the very center of Europe’s troubled Geist. But can anything be done to save the most important European values, and specifically, the ethical drive to say “no” to power, which is perhaps the most important legacy of monotheism? Either as a self-limitation from within powerful institutions or as a mode of resistance on the margins of powerful developments—there is a strong adherence to the good (often named God) that helps people and communities survive their diasporic state. I will present this kernel of ethical monotheism by two relatively unknown twentieth-century examples of “diasporic knowledge”: Rebecca West’s Black Lamb and Grey Falcon (1941), in which she recorded her observations of the devastating effects of empires on Yugoslavia, and two poems by Rosario Castellanos, who decades before the debate on postcolonialism voiced the concerns of displaced indigenous cultures in her Mexican homeland. I suggest that, paradoxically, attention to diasporic voices is one way of realizing the spirit of European self-limitation that is so much needed today to prevent further damage to our societies and environment wrought by the excessive drive for progress fostered by an unethical monorationalism. ZusammenfassungEthische Aspekte von Biobanken-basierter Forschung werden zunehmend kontrovers diskutiert. In diesem Artikel wird die Debatte um ethisch angemessene Formen der Einwilligung in Biobanken-basierte Forschung nachgezeichnet. Nach einer Einführung in etablierte Einwilligungsmodelle skizziert der Beitrag kurz die Entwicklung alternativer Ansätze und diskutiert die damit verbundenen ethischen und regulatorischen Herausforderungen. Dabei wird dargestellt, welche ethischen Prinzipien in diesen Diskussionen eine Rolle spielen. Der Beitrag schließt mit einem Ausblick für Deutschland.

Since the passage of Title VII of the Civil Rights Act of 1964 and more recent Federal legislation, managers, regulators, and attorneys have been busy in sorting out the legal meaning of fairness in employment. While ethical managers must follow the law in their hiring practices, they cannot be satisfied with legal compliance. In this article, we first briefly summarize what the law requires in terms of fair hiring practices. We subsequently rely on multiple perspectives to explore the ethical meaning (...) of fairness in hiring. Ethical fairness underlies the law and regulations in this area, but goes beyond them as well. We conclude by demonstrating that ethical hiring practices enable managers to make better hiring decisions. (shrink)

Research has demonstrated that employee reactions to monitoring systems depend on both the characteristics of the monitoring system and how it is implemented. However, little is known about the role individual differences may play in this process. This study proposes that individuals have generalized attitudes toward organizational control and monitoring activities. We examined this argument by assessing the relationship between employees’ baseline attitudes toward a set of monitoring and control techniques that span the employment relationship. We further explore the effects (...) of employees’ generalized attitudes toward monitoring and their individual ethical orientations on their attitudinal reactions to an Internet monitoring system implemented in their workplace. Results of a longitudinal study indicate that as expected, prior beliefs and ethical orientation interact to affect employees’ reactions to monitoring systems. In recent years, the practices of work organizations have raised increasing concerns regarding individual privacy at work. It is clear that people expect and value privacy in their personal lives. However, the extent to which privacy perceptions influence individuals’ work attitudes is less clear. Research has explored the extent to which employee perceptions of privacy derive from characteristics of the programs themselves. However, there is a paucity of research that examines how the characteristics of the individual employee may influence perceptions (...) of these programs. In this study we seek to shed light on this issue, as we examine how the individual ethical orientation of employees influences perceptions of a variety of human resource programs that have the potential to be perceived as invasive. Results indicate that ethical orientation exerts direct effects on perceived invasiveness of programs and exerts both direct and indirect effects on perceived appropriateness of programs. Implications for research and for managers adopting privacy-related programs are discussed. (shrink)

Extensive and growing use of electronic performance monitoring in organizations has resulted in considerable debate. Advocates of electronic monitoring approach the debate in teleological terms arguing that monitoring benefits organizations, customers, and society. Its critics approach the issue in deontological terms countering that monitoring is dehumanizing, invades worker privacy, increases stress and worsens health, and decreases work-life quality. In contrast to this win-lose approach, this paper argues that an approach which emphasizes communication in the design and implementation of monitoring systems (...) offers a win-win solution that should satisfy both deontological and teleological ethicists. ABSTRACT This essay argues that historians of science who seek to embody our oxymoronic self-description must confront both contradictory terms that define our common enterprise—that is, both “history” and “science.” On the history/methods side, it suggests that we embrace the heterogeneity of our institutional arrangements and repudiate the homogeneous disciplinary model sometimes advocated by Thomas Kuhn and followed by art history. This implies that rather than treating the history of science as an end in itself, we consider it a means (...) to a variety of historical ends, think of ourselves as a tool-making community, and jettison moralistic assertions of scientific exceptionalism. To do so, this essay argues—on the science/subject side—that we rebrand the subject of our historical inquiry as “episcience,” a neologism that stands in relation to “science” as the new field of epigenetics does to the old genetics. Episcience encompasses both the material activities of the relevant sciences and their “surround” (environment, milieu, Umgebung) to reframe knowledge making to include the material processes that put science “in play” and make its findings matter beyond science. The essay concludes that “the history of science” is an oxymoron that makes sense to the extent that its practitioners acknowledge that the history of science is important not just because science is important, but because its history is. Legal mobilization in the courts and in political discourse has emerged as an increasingly important strategy of social movements that complements other political approaches. This is true also for women’s movements in post-socialist countries, but most research on strategic litigation has focused so far on common law countries and on supranational litigation in Europe. Using the case of Poland as an example, this article asks why references to the law are so attractive in post-socialist contexts and what can be gained (...) by this with respect to actual rights, justice and social change. It focuses thereby on strategic litigation as the most sophisticated strategy that results from other sustained movement activities connected with the law. It draws on field research, interviews with activists and analyses of primary as well as secondary sources. The article explores the reasons for using the law as the ‘master frame’ by analysing the traditions of gender and law in state socialism and during democratic consolidation. Two examples of strategic litigation, the Tysiąc case for reproductive rights and the ‘Biedronka’ cases for employment rights, are analysed and situated in the context of other legal mobilization activities. These cases set the agenda for crucial social problems and resulted in binding decisions by the courts. A broad and predominantly supportive media discourse was conducive to cultivating public opinion. These analyses support the conclusion that legal mobilization tends to directly influence law and legal practices. It has a socializing effect on the population and their legal consciousness. In aiming at both state and society, these legal strategies of the women’s movement are a modest but crucial success for democratic consolidation. (shrink)

Not only did it divide Jews and Christians, it also caused divisions among Jews and among Christians as well. In the 20th century, philosophers and political leaders attached increasing importance to it in a more secular form. The authors of the articles collected in this volume deal with the subject of messianism in the 20th century in various contexts. The articles are written from the standpoint of different (...) disciplines and provide a multifaceted perspective of a spiritual and intellectual phenomenon that deserves further research. German description: Die Verhaltnisse von religiosen und sakularen Ordnungen stehen neu zur Debatte. Sah es lange so aus, als wurden die sakularen Ordnungen sich nach und nach gegen die religiosen durchsetzen, so hat sich dieses Bild entschieden verkehrt: Die neue Hinwendung zu Religionen ist ein politisch relevantes Thema geworden. Das Phanomen des Messianismus hat in allen Umbruchzeiten eine schillernde Zwischenstellung gehalten. So konnten einerseits die christlichen Theologien von aussen als der Versuch beschrieben werden, einen durch seinen Tod den meisten als afalsch erwiesenen Messias zum richtigen Messias umzudeuten. Die rabbinische Bewegung kann demgegenuber in ihrer Weigerung, diese Umdeutung mitzuvollziehen, als die Kraft bezeichnet werden, die einen anderen Begriff vom Messias in Kontradistinktion zum christlichen entwickelte. Drittens spielt das Messianische innerhalb der Religionen in den Gegenbewegungen zu den grossen religiosen Instituten eine wieder andere Rolle: In dem Masse, in dem die aufgeklarte Welt nicht mehr gegen eine starke Kirche opponieren musste, sondern selbst ihr astahlernes Gehause errichtet hatte, wurde adas Messianische gerade fur Philosophen zu einer Kraft, die als Garant fur das Unbestimmbare der Zukunft mehr oder weniger deutlich bestimmt wurde. Over the past few years, even before the Brexit campaign and the outcome of the 2016 referendum in the United Kingdom, Europe has been haunted by the spectre of an impending split and disintegration of the Union. Self-appointed “kings” and “philosophers” of greater Europe seem to have been competing for the “unity award,” with more and more of them failing dramatically. One indicator of the public alarm at the prospect of the Union’s split is the exaggerated use of the word (...) “unity” and its cognates. But can the rhetoric of unity act as a cure for the disease? This essay suggests that, ironically, the constant use of organic metaphors and invocations of European unity seems to be paving the way for—rather than preventing—the rise of neo-authoritarian forces. However, the link between Cohen?s system and the Star of Redemption, is hard to find. Looking (...) back from the perspective of a?return of religion? in late twentieth century, the essay proposes to see the link between both systems in Cohen?s notion of compassion. Nemacko-jevrejski filozofi Herman Koen i Franc Rozencvajg su - svaki na svoj nacin - produkovali sisteme filozofije u vremenu koje je trebalo da vazi kao vreme posle sistema. Svojim sistemima su - takodje svaki na svoj nacin, prevazilazili apologetsko stanoviste jevrejske misli uspostavljajuci jevrejstvo svoje misli kao centralnu metodsku tacku?opste filozofije?. Medjutim, tesko je naci vezu izmedju Koenovog sistema i Zvezde iskupljenja. Gledajuci unazad, iz perspektive?povratka religije? u kasnom dvadesetom veku, rad pokusava da nedje vezu izmedju pomenuta dva sistema u Koenovom pojmu saosecanja. (shrink)

In der Wissenschaftsgeschichte des 18. Jahrhunderts steht die deutsche Tradition sprachbasierter Erkenntnistheorie im Schatten der primär rationalistischen Strömungen. Der an Leibniz' Begriff der cognitio symbolica ebenso wie an den englischen Empirismus Bacons und Lockes anknüpfende Ansatz gerät dabei in den Hintergrund, obwohl diese Traditionslinie, die sowohl rationalistische als auch empiristische Elemente vereinbart, bis zum Ende des 18. Jahrhunderts fortbesteht. Dies hat weitreichende Konsequenzen sowohl für die Philosophie- und Literaturgeschichte als auch für die literaturwissenschaftliche Detailforschung, da weder Herders Erkenntnistheorie noch die (...) poetologischen Konzeptionen des 'Anti-Klassikers' Jean Paul und des Frühromantikers Novalis ohne Kenntnis der theoretischen Voraussetzungen erklärt werden können. Unter Auswertung empirisch belegbarer Quellen wie handschriftliche Nachlässe, Briefwechsel und Zitate wird die Entwicklung eines semiotischen Wissensbegriffs bis zu seinen Ursprüngen im 17. Jahrhundert zurückverfolgt und schrittweise nachvollzogen: Die theoretische Ausbildung erfolgt um 1760 durch den für die Wissenschaftsgeschichte des 18. Jahrhunderts höchst bedeutsamen Philosophen und Naturwissenschaftler Johann Heinrich Lambert (1728-1777). Eine systematische und historische Analyse der zentralen Schrift Herders "Eine Metakritik zur Kritik der reinen Vernunft" aus dem Jahr 1799 ergibt, daß Lamberts Ansatz in Herders Entwurf der Zeichenabhängigkeit allen menschlichen Denkens konsequent rezipiert wird. Schließlich müssen die poetologischen Konzeptionen Jean Pauls in der "Vorschule der Ästhetik" und in Novalis' "Theoretischem Werk" in die genannte Traditionslinie eingebunden werden. Infolgedessen sind besonders die Begriffe des Witzes und der Ironie Jean Pauls sowie der romantische Kritik-Begriff Novalis', der seine Enzyklopädistik stützt, wesentlich schärfer zu fassen als bisher. This essay pairs two prototypically American technological objects of the mid‐twentieth century: the atomic bomb and the lie detector. Although the former has been touted as the supreme achievement of modern technoscience, and the latter dismissed as a placebo device, the two “gadgets” actually performed in analogous fashion. Indeed, the essay suggests that these technologies are best understood not in terms of narrow functionality but in terms of their performance—akin to that of Frankenstein’s monster—in the domains of justice, popular culture, (...) and geopolitics. Specifically, it argues that the mutually supportive roles played by the two objects underscore the ways in which the theater of deterrence sustained American sovereignty during the era of the Cold War.
